18 U.S.C. § 2257 Statement

Exemption and compliance statement.nghtstand, Inc. ("nghtstand") operates an adults-only, location-based social and dating platform. nghtstand does not produce, create, or commission any of the images or other content exchanged by its users. All content is created, uploaded, and shared solely by users of the Service, who act as the producers of their own content. With respect to any content it hosts, nghtstand's activities are limited to transmission, storage, hosting, moderation, and similar functions, and nghtstand acts only as a provider of those services.

To the extent any content on the Service is subject to 18 U.S.C. §§ 2257 and 2257A and their implementing regulations, the obligation to create and maintain records rests with the users who produced the content. Every user represents and warrants, as a condition of using the Service, that they are at least 18 years old, that every person depicted in any content they upload or share is at least 18 years old at the time the content was created, and that they have obtained and maintain records establishing the identity and age of every person depicted, along with that person's consent to be depicted and to have the content shared.

nghtstand maintains age and identity information collected at sign-up and, where applicable, through optional verification, and cooperates with lawful requests from authorities. nghtstand has a zero-tolerance policy for any content that involves a minor and reports child sexual exploitation to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement as required by law.
