Uploader Agreement

This agreement is between you and Nghtstand, Inc.. You accept it when you create an account, and it applies every time you upload a photograph — to your profile, to the board, or in a message. It sits alongside our Terms and Content Policy, and where this agreement is stricter, this agreement applies.

nghtstand is a dating and messaging site. It is not a marketplace, there are no creators or performers here, and nothing you upload is sold, licensed or used by us to promote the site.

1. Your content must be lawful

You will not upload anything that is illegal or that breaks our Content Policy. That includes, without limitation, any content involving a minor, any content depicting non-consensual activity, any content that promotes trafficking, exploitation or coercion, and any content offering or soliciting commercial sexual services.

2. Everyone in your photographs must have agreed

Most photographs on nghtstand are of the person who uploaded them. Where anyone other than you appears in a photograph, you must have that person's consent before you upload it, and that consent must cover all of the following:

• that they are depicted in the content;
• that the content may be distributed publicly and uploaded to nghtstand; and
• where the content can be downloaded by other members, that it may be downloaded.

You must keep a record of that consent, and you must be able to produce it if we ask. Uploading a photograph of somebody who has not agreed to it is a serious breach of this agreement and of our non-consensual content policy.

3. Everyone in your photographs must be an adult

You confirm that you are 18 or over, and that every person appearing in anything you upload is 18 or over. You are responsible for verifying the identity and age of anyone else who appears, and for being able to provide supporting documentation to us on request.

We screen every photograph before it is published. Anything our systems flag as involving a minor is rejected automatically and escalated for review and reporting. There are no exceptions and no appeals on that point.

4. Verification

We may require you to verify your age and identity before your content can be shown publicly, and we may withhold publication until you do. Where we use a third-party verification provider, that provider performs the check and we hold only the result — we do not store your identity documents.

5. What we do with your content

We display it to other nghtstand members, which is the point of the site. We do not sell it, license it, or use it to advertise nghtstand. You keep ownership of everything you upload. You can delete any photograph at any time, and deleting your account deletes your photographs.

6. If you break this agreement

We remove the content and, depending on what happened, suspend or terminate your account. Content involving a minor is reported to the appropriate authorities, including the National Center for Missing & Exploited Children, and the account is terminated immediately and permanently.
