Content & Safety Policy

nghtstand, Inc. ("nghtstand," "we," "us") operates an adults-only, location-based social and dating service for gay and bisexual men. This Content & Safety Policy explains what is and is not allowed, how content is moderated, how to report a problem, and how anyone depicted in content can have it removed. It works together with our Terms, Privacy Policy, and 18 U.S.C. § 2257 statement.

1. Adults only, and consent is required

nghtstand is strictly for adults 18 years of age or older. Every user confirms their date of birth at sign-up, and we may require identity or age re-verification at any time. All adult content shared on the Service must involve only consenting adults, and every person who appears in an image must have consented both to being depicted and to that image being shared. Adult content on nghtstand is user-generated. It may appear on profiles, the community board, and in private messages between consenting adults. Regardless of where it appears, every person shown must be a consenting adult, and identity-verification selfies must be clothed and non-explicit.

2. Zero tolerance: child sexual abuse material (CSAM)

Any content that involves, sexualizes, or endangers a minor, or any child sexual abuse material (CSAM), is absolutely prohibited. This is a zero-tolerance rule with no exceptions. We use automated image scanning together with human review to detect such material. When it is detected or reported, we remove it immediately, terminate the account, and report it to the National Center for Missing & Exploited Children (NCMEC) through the CyberTipline and to law enforcement as required by law, and we preserve related records as required. We do not permit any content, username, profile text, or search term that suggests, markets, or implies the presence of minors.

3. Prohibited content and conduct

In addition to CSAM, the following are prohibited on nghtstand:

• Non-consensual sexual content of any kind, including "revenge porn," hidden-camera or covertly recorded content, and sharing intimate images of a person without their consent, or threatening to do so.
• Content that depicts, promotes, or facilitates human trafficking, sex trafficking, sexual exploitation, or coercion.
• Prostitution, escorting, commercial sexual services, or any "pay-to-play" arrangement solicited or arranged through the Service.
• Content depicting or promoting bestiality, necrophilia, incest, rape or non-consent themes, or any nonconsensual or otherwise illegal sexual act.
• Real violence, gore, self-harm, or content that threatens, harasses, or incites violence against any person or group; hate speech.
• Selling or soliciting illegal drugs, controlled substances, weapons, or any other illegal goods or services.
• Impersonation, fake profiles, misrepresenting your age or identity, and posting another person's private or identifying information ("doxxing").
• Marketing the Service, or using search terms, usernames, or content, in a way that gives the impression that it contains child exploitation material or the depiction of nonconsensual activity.
• Spam, scams, phishing, bots, chain messages, or repeated unsolicited messages; and advertising, promoting, or recruiting users to any other website, app, service, or business, including competing platforms, whether through a board post, message, group, profile, or photo.

We reserve the right to remove any content and to suspend, ban, or delete any account at any time, with or without notice, and at our sole discretion, including for any of the above.

4. How content is moderated

Every image uploaded to nghtstand is automatically scanned before it is shown, and no image is displayed until it passes that scan. Automated screening is backed by user reporting and human review. nghtstand is an adult (18+) platform: consensual adult nudity and sexual content are permitted on profiles, the board, and in messages, provided every person shown is a consenting adult and you have the right to post it. Content must never depict a minor or anyone who is not a consenting adult, must not misrepresent whose images they are (no impersonation or "catfishing"), and identity-verification selfies must be clothed and non-explicit. We may hold, blur, reject, or remove any content, and limit or remove any account, at our discretion, and we operate on a platform we fully control so that content can be monitored and removed.

5. Reporting a problem, and our response time

Anyone can report content or an account that may be illegal or that violates this Policy. Users can report or block another user directly in the app (from any profile or conversation), and anyone, including non-users, may email us at support@nghtstand.com. We review and resolve reported complaints within seven (7) business days. Where a review finds content that is illegal or involves a minor, we remove that content immediately and report it to the appropriate authorities.

6. Removal and appeal for anyone depicted

If you are depicted in any content on nghtstand and you want it removed, including if you did not consent to it being shared, email support@nghtstand.com with enough detail for us to locate the content. When such a request is received, we will, through a reasonable process, confirm whether the required consent was obtained. If consent cannot be established, or if the person depicted can show that consent is void under applicable law, we will remove the content with immediate effect. If we disagree that consent is void, we will allow the disagreement to be resolved by a neutral body, at our expense. This right applies whether or not you are a nghtstand user.

7. Anti-trafficking and exploitation

nghtstand has zero tolerance for human trafficking, sex trafficking, and the sexual exploitation of any person. We prohibit any use of the Service that promotes or facilitates trafficking, exploitation, or abuse; we act on reports and detections by removing content, terminating accounts, and reporting to the authorities; and we maintain and enforce policies and staff practices directed at preventing this activity. We report child sexual exploitation to NCMEC, and we intend to maintain membership in the Association of Sites Advocating Child Protection (ASACP) and to follow its best practices.

8. Records and reporting

We keep records of moderation actions, complaints, and takedown requests, and we provide periodic compliance reports to our payment processor and its acquiring bank on request, including content flagged as potentially illegal or in violation of these standards and the actions we took.
