How police and government agencies request records

nghtstand, Inc., a Delaware corporation at 925 N La Brea Ave, Suite 500, Los Angeles, CA 90038, runs nghtstand.com, a website for adults where members find people nearby on a map and message each other. This page explains how law enforcement can request records about a nghtstand account.

How to reach us

Email support@nghtstand.com from an official government email address. Please include your agency, your name and badge number, a phone number we can verify, the legal process (attached), and how to identify the account: a nghtstand case number (it looks like NS-26-00001), the member's display name, or the email address on the account. Requests from personal email addresses are not accepted.

What legal process we need

A member who was part of a conversation may consent to us sharing that conversation with police. When a member reports a meetup and gives that consent, the letter we give them says so.

Preservation requests

We honor preservation requests under 18 U.S.C. 2703(f): we keep the records we have for 90 days, and for another 90 days if you renew the request, while you get legal process. When a member reports a meetup on nghtstand, we already keep the records of both accounts for one year from the report, and the member gets a case number and a letter for you.

Emergencies

If there is a danger of death or serious physical injury, write EMERGENCY in the subject line and tell us what the danger is and why it is urgent. We may disclose records without legal process when we believe in good faith that an emergency requires it (18 U.S.C. 2702(b)(8) and (c)(4)). We verify every emergency request by calling the agency back on a number we look up ourselves, never one given in the request.

How long we keep records

Records we no longer have can't be produced, so please send a preservation request early.

Telling the member

We tell a member when a government agency requests their records, unless a court order forbids it (18 U.S.C. 2705(b)), it is an emergency, it involves a child, or telling them could put someone at risk. We never tell a member who reported them.

Response times

We aim to answer emergency requests the same day and other requests within 14 days.

Child safety

Content involving a minor is reported to the National Center for Missing & Exploited Children (NCMEC) as the law requires, and the related records are preserved.

Other requests

We don't disclose the content of messages in response to a civil subpoena. Civil requests for other records go to the same address. We never give one member another member's personal information.

If you are a member

If someone you met on nghtstand robbed you, hurt you or threatened you, call 911 if you are in danger, then choose "Something happened when we met" in your conversation with them or under Account.
